Chapter 17.42 - DAY CARE FACILITIES

17.42.010 - Family day care home provisions.

Family day care facilities shall:

A.

Be properly licensed by the State of Washington Department of Social and Health Services, Division of Children and Family Services;

B.

Comply with all building, fire, safety, health codes and business licensing requirements;

C.

Conform to lot size, building size, setbacks, and lot coverage standards applicable to the zoning district except if the structure is a legal nonconforming structure;

D.

Be certified by the Washington State Office of Child Care Policy licensor as providing a safe passenger loading area;

E.

Meet signage requirements applicable to the zoning district;

F.

Limit hours of operations to facilitate neighborhood compatibility;

G.

Apply for and obtain a home occupation permit concurrently with state licensing. The home occupation permit may be administratively approved by the mayor or his/her designee, certifying that all conditions in this section are met;

H.

Prior to state licensing, provide proof of written notification to the immediately adjoining property owners, that they have been informed of the intent to locate and maintain such a facility. If a dispute arises between neighbors and family day care provider over licensing requirements, the licensor may provide a forum to resolve the dispute. Written notification to immediately adjoining property owners shall include the following information:

Nature of the application;

2.

Maximum number of children to be cared for;

3.

Maximum number of employees;

4.

Days and hours of operation.

17.42.020 - Day care center provisions.

A day care center shall meet all of the requirements contained within Chapter 17.44, Conditional Uses, and Chapter 17.34, Home Occupations.
