Chapter 17.26 - FENCE REGULATION IN RESIDENTIAL AND LIGHT INDUSTRIAL ZONES

17.26.010 - Fence Regulation in Residential and Light Industrial Zones

A.

The following regulations apply to all fences erected in R1 Residential, R2 Residential and General Business zones.

1.

All fences must be structurally sound and of good workmanlike quality and must be maintained to prevent loss of integrity.

2.

Fences shall not be equipped with or have barbed wire, spikes, concertina, or any other types of materials intended to cause harm to persons or animals.

3.

Front yard fences shall not exceed four feet in height with the following exceptions: fences erected on a corner lot shall not exceed three feet in height in the side yard adjacent to the street; fences on corner lots are restricted to three feet maximum height; fences on alley corner lots shall not exceed three feet six inches in height. The intent of these height restrictions is to comply with Naches Municipal Code Section 17.36.070 relating to clear vision areas.

Unless otherwise provided, rear and side yard fences shall not exceed six feet maximum height.

No fence shall be erected less than five feet from the curb gutter line.

No fence shall be located on any town right of way or easement with the authorization of the town by way of a right-of-way use permit or lease. Any fence located within a town right-of-way or easement is subject to removal, without notice to the property owner, by order of the mayor and/or his/her designee.

The erection of a fence less than six feet in height shall not require a permit. The erection of a fence over six feet in height shall require a building permit pursuant to the Naches Building Code.

B.

In the Light Industrial (LI) zones only, fences consisting of material restricted in section two above may be allowed, but only by prior authorization of the Naches town council. No above ground electrified fences shall be allowed in any zone in the town. All fences erected in the LI zones shall be structurally sound and of good workmanlike quality. All material used shall be suitable for commercial fencing and must be maintained to prevent loss of structural integrity.
