2.04.030 - Standing rules of procedure.
The following standing rules be and the same are prescribed for the government of the council of the town:
A. Roberts' Rules of Order be, and is, adopted as the rules of procedure in all parliamentary matters coming before the council
of the town, in so far as same does not conflict with the provisions of this section.
B. A majority of the members of the council shall constitute a quorum.
C. All members present are required to vote on every question, order, measure, resolution or proposition that is submitted to
the council for a vote.
D. At each meeting the minutes of the preceding meeting of the council, are to be read, and corrected if erroneous, and signed
by the presiding officer and attested by the clerk.
E. The mayor may vote only in case of a tie, and shall have casting vote unless interested other than as a citizen.
F. All questions of order shall be decided by the presiding officer, subject to an appeal to the council.
G. Every order, motion, resolution, proposition or measure put to the council for vote shall be reduced to writing if required
by the presiding officer, or any member of the council.
H. When a motion is made and seconded it shall be deemed to be in possession of the council, and shall be stated by the presiding
officer, or if in writing, read by the clerk, previous to debate, but such motion may be withdrawn before decision or amendment
by consent of the council.
I. The order of proceeding with the business of the council, at the meetings thereof, shall be as follows: (1) roll call; (2)
reading and approving of minutes; (3) presenting and disposing of accounts; (4) presenting and acting on petitions; (5) reports
of standing committees; (6) reports of special committees; (7) unfinished business; (8) ordinances; (9) miscellaneous business.
J. The first reading of an ordinance proposed shall be for information, and, if objection be made, the following question shall
be put: Shall the proposed ordinance be rejected? If no objection be made, or the question to reject be lost, the ordinance
shall be read a second time without further question, after which it shall be subject to amendment and debate.
K. When a question or motion is before the council no motion shall be received, unless it be to amend, postpone, lay on the table,
or consider the main question, or to adjourn.
L. Motion to adjourn shall always be in order except when the council is engaged in voting.
M. An order or resolution, after commitment to a committee for report, and report thereon having been made, may be recommitted
to the same or another committee before passage.
N. All standing and special committees shall be appointed by the mayor.
O. The standing committees shall be as follows, and shall consist of three members each:
1. Finance committee;
2. Street, alleys and highways committee;
3. Light, water and sewer committee;
4. Judgment and ordinance committee;
5. Town property committee;
6. Police and fire committee;
7. Public privileges committee;
8. Audit and demand committee.
P. All reports of committees shall be in writing, and signed by the members thereof, or chairperson, and shall specify in the
form of a resolution at the close of such report, what action in the premises the committee recommends or propose for the
council to adopt.
Q. No member shall leave a meeting of the council without permission of the presiding officer.
R. Charges against an officer of the town shall be verified by the affidavit of the complainant, and in writing, and shall be
at once laid upon the table or referred to a committee for investigation without debate.
S. It shall require two-thirds of the members present to reverse the decision of the presiding officer upon appeal.
